Protection of personal data

LL REMAKE takes privacy and the protection of the personal data of its Clients, learners, prospects and visitors (the “Data”) very seriously. This policy describes how this Data is collected, used, stored and protected, and sets out the rights of data subjects.

1 · Legal framework

LL REMAKE undertakes to process Data in accordance with the applicable provisions, in particular Regulation (EU) 2016/679 of 27 April 2016 on the protection of personal data (the “GDPR”) and amended French Law No. 78-17 of 6 January 1978, known as the “Loi Informatique et Libertés”.

3 · Purposes of processing

Data is collected and processed for the following purposes:

• Managing registrations for Training and services
• Performing training contracts and agreements
• Managing the Client relationship (order follow-up, invoicing, support)
• Managing access to the online training platform, where applicable
• Sending communications about Training (invitations, reminders, certificates)
• Improving the quality of Training (evaluations, satisfaction surveys)
• Complying with legal and regulatory obligations (declarations to funding bodies, archiving of training documents)
• Business prospecting and sending newsletters, with the person's consent or on the basis of legitimate interest within an existing professional relationship
• Anonymised statistics and analyses to improve services

4 · Legal bases for processing

Each processing operation is based on a specific legal basis in accordance with Article 6 of the GDPR:

• Performance of the contract or pre-contractual measures, for managing registrations, delivering Training and following up the Client relationship
• Compliance with a legal obligation, for invoicing, accounting archiving and declarations to funding bodies
• The legitimate interest of LL REMAKE, for prospecting professionals with whom there is an existing business relationship and for improving services
• Consent, for sending newsletters to people outside a contractual relationship, which may be withdrawn at any time

5 · Data collected

The categories of Data collected may include:

• Identification data (surname, first name, company name, position)
• Contact details (postal address, email, telephone)
• Professional data (company, sector of activity, SIRET or SIREN, ORIAS number where applicable)
• Connection data (logs, IP address, browsing history)
• Training data (sessions attended, evaluations, results, attendance)
• Bank data, for processing payments, through secure payment providers

No sensitive data within the meaning of Article 9 of the GDPR is collected without necessity and without an appropriate legal basis.

6 · Recipients of the Data

Internally, Data is intended for the LL REMAKE departments in charge of administrative and commercial management, training delivery, technical support and accounting. It may also be shared, strictly to the extent necessary:

• With processors and service providers (hosting provider, payment platforms, management tools, registration tool, emailing platform, e-learning platform), which contractually undertake to respect the security and confidentiality of the Data
• With funding bodies (OPCO, Training Insurance Funds, France Travail) for the management of funding
• With administrative or judicial authorities, where required by law

For information, the main processors used in the registration and training process are form collection, payment, emailing, hosting and learning management tools. The up-to-date list can be provided on request.

7 · Transfers outside the European Union

LL REMAKE favours providers that host Data within the European Union. When processing involves a transfer of Data outside the European Union, LL REMAKE ensures that the transfer is subject to appropriate safeguards within the meaning of the GDPR (European Commission adequacy decision or standard contractual clauses).

8 · Retention period

Data is kept for as long as strictly necessary for the purposes for which it was collected:

At the end of these periods, Data is deleted or anonymised.

9 · Data security

LL REMAKE implements all appropriate technical and organisational measures to ensure the security and confidentiality of Data and to prevent it from being altered, damaged or accessed by unauthorised third parties. These measures include in particular encryption of sensitive data, secured access, regular Data backups, staff awareness of confidentiality, and careful selection of processors offering sufficient guarantees.

10 · Rights of data subjects

In accordance with the applicable regulations, any person whose Data has been collected has the following rights:

• Right of access: to obtain confirmation that Data concerning them is being processed and to access it
• Right to rectification: to have inaccurate or incomplete Data corrected
• Right to erasure: to have their Data erased, subject to legal retention obligations
• Right to restriction of processing in certain circumstances
• Right to object to processing on grounds relating to their particular situation, and at any time to business prospecting
• Right to data portability: to receive the Data provided in a structured, machine-readable format
• Right to set instructions regarding what happens to their Data after their death

To exercise any of these rights, the data subject sends a request to hello@llremake.studio or by post to the registered office, together with a copy of a valid identity document. LL REMAKE undertakes to reply within one (1) month of receipt of the request, which may be extended by two months in complex cases, with prior notice to the data subject.

11 · Right to lodge a complaint with the CNIL

12 · Cookies and trackers

The llremake.studio website may place cookies and trackers to ensure it functions properly, to measure its audience and, with the user's consent, to offer suitable content. Cookies strictly necessary for the functioning of the website do not require consent. Other cookies (audience measurement, personalisation) are only placed after the user's consent has been obtained, which may be withdrawn at any time through browser settings or the website's cookie management tool.

13 · Processing and Data provided by the Client

When the Client provides LL REMAKE with personal data concerning third parties (for example the contact details of employee Participants) in the course of delivering Training, the Client acts as data controller and LL REMAKE as processor. In this capacity, LL REMAKE undertakes to process the Data only for the defined purpose, in accordance with the Client's documented instructions, to guarantee its confidentiality, to assist the Client in meeting its obligations (responses to requests to exercise rights, notifications of data breaches, impact assessments), and to allow the Client to carry out audits under agreed arrangements. The Client guarantees that it holds all necessary rights over the Data provided and that it has informed the data subjects.

14 · Changes to this policy

LL REMAKE reserves the right to amend this Privacy Policy at any time, in particular to adapt it to legal, regulatory or technical developments. The applicable version is the one in force on the date of consultation, available on the llremake.studio website. In the event of a substantial change, LL REMAKE strives to inform the data subjects.
